Construction Ecological Management Plan (CEMP)

It’s common for planning permissions to come with a pre-commencement condition requiring the approval of a Construction Ecological Management Plan (sometimes referred to as a CEMP or CEcMP) – not to be confused with a Construction Environmental Management Plan, which typically covers non-ecological matters such as construction waste, traffic management and pollution control.

A Construction Ecological Management Plan sets out how any risk of harm to wildlife during the build phase will be managed and mitigated. Typical elements include:

  • Timing of Works
    Scheduling disruptive activities (e.g. vegetation clearance, earthworks) to avoid sensitive periods such as nesting bird season or bat roost emergence.

  • Protective Fencing & Buffer Zones
    Erecting temporary barriers around trees, watercourses, hedgerows or other features of ecological value to prevent accidental damage.

  • Pollution & Disturbance Control
    Measures to manage runoff, dust, noise and light spill so that adjacent habitats remain undisturbed.

  • Species-Specific Safeguards
    Tailored precautions—for example, hand-searching topsoil for reptiles before excavation or installing amphibian tunnels beneath temporary access roads.

A good CEMP is developed in close collaboration with your design and construction teams so it dovetails seamlessly with your build programme and methods. In many cases, submitting the CEMP as part of your planning application (rather than post-decision) can give the planning authority confidence that you’ve fully addressed potential ecological risks up front.

Habitat Management Plans (HMP) and Habitat Management & Monitoring Plans (HMMP)

Two related documents come up routinely on planning permissions, and although they are often spoken about interchangeably the distinction matters.
A Habitat Management Plan (HMP) is the long-form document that describes how newly created or enhanced habitats – for example new hedgerows, species-rich grassland or wetland scrapes – will be looked after over the long term. HMPs are commonly imposed as planning conditions where habitat creation is part of a permission, whether or not the project triggers mandatory BNG.

A Habitat Management & Monitoring Plan (HMMP) is the BNG-specific version of that document. It is required for every site delivering biodiversity net gain under the Environment Act 2021, and it sets out not only the management regime but also the formal monitoring schedule (years 2, 5, 10, 15, 20, 25 and 30) and the condition targets each habitat parcel must hit. The HMMP is the regulatory anchor for the 30-year monitoring obligation — and the document the LPA will measure compliance against.

Key components of an HMP include:

  • Habitat Creation & Enhancement
    Specifications for planting native hedgerows, sowing species-rich grassland mixes, creating wetland scrapes or installing bat and bird boxes.

  • Long-Term Management Regime
    A multi-year schedule of tasks—mowing, selective grazing, scrub control, invasive species removal and pond maintenance—to maintain habitat quality and structural diversity.

  • Monitoring & Reporting
    Site inspections and condition assessments at the years prescribed by the HMMP — typically years 2, 5, 10, 15, 20, 25 and 30 for BNG sites — with formal progress reports to the Local Planning Authority and any Responsible Body holding a covenant, demonstrating that habitat targets (e.g. 10% net gain) are being achieved.

  • Adaptive Management
    Clear triggers and decision-trees for adjusting management techniques if monitoring shows certain habitats or species aren’t responding as expected.

By embedding clear responsibilities, timelines and success criteria, an HMP transforms a one-off planting scheme into a sustained programme of ecological enhancement—securing real biodiversity benefits long after construction crews have left site.
